Financial Responsibility Agreement

Beginning with the Spring 2026 semester, all University of Dayton students are required to accept the Financial Responsibility Agreement (FRA) as part of registration.

Signing the agreement is acknowledgment of your financial obligations related to enrolling in classes, and your understanding of the potential consequences that may result if you fail to meet your obligations. Our goal is to help students to understand their financial responsibilities, as well as UD's financial policies and expectations for payment.

Failure to agree to the Financial Responsibility Agreement will result in inability to register for future courses.

Payment of Fees/Promise to Pay

I understand when I register for any class at University of Dayton or receive any service from University of Dayton, I accept full responsibility to pay all tuition, fees, charges, and other associated costs assessed as a result of my registration and/or receipt of services. I further understand and agree my registration and acceptance of the terms in this Financial Responsibility Agreement (to which the University of Dayton and I are Parties) constitutes a contractual agreement (i.e., a financial obligation in the form of an educational loan as defined by the U.S. Bankruptcy Code at 11 U.S.C. §523(a)(8)) in which University of Dayton is providing me educational services, deferring some or all of my payment obligation for those services, and I promise to pay for all assessed tuition, fees, charges, and other associated costs by the published or assigned due date. My student account indicates whether I have a balance I owe for educational services obtained from University of Dayton.

I understand and agree that if I drop or withdraw from some or all of the classes for which I register, I will be responsible for paying all or a portion of tuition and fees in accordance with the published tuition refund schedule at Refunds for Drop/Withdrawal : University of Dayton, Ohio I have read the terms and conditions of the published tuition refund schedule and understand those terms are incorporated herein by reference. I further understand my failure to attend class or receive a bill does not absolve me of my financial responsibility as described above. I additionally understand that a change by the University of Dayton in how it delivers the educational content for which the tuition is assessed (e.g., a change from in-person to online/remote, vice versa, or otherwise) nor any change in my access to facilities does not absolve me of my full financial responsibility as described above.

Delinquent Account/Collection/Certain Charges and Fees

Financial Hold: I understand and agree if I fail to pay my student account bill or any monies due and owing University of Dayton by the scheduled due date, University of Dayton will place a financial hold on my student account, which can prevent me from registering for future classes, obtaining transcripts, or receiving my diploma and/or receiving other services.

Late Payment Charge: I understand and agree that if I fail to pay my student account bill or any monies due and owing to University of Dayton by the scheduled due date, University of Dayton will assess late payment and/or finance charges at the rate of 1% per month on the past-due portion of my student account until my past-due account is paid in full.

Collection Agency Fees: I understand and accept that if I fail to pay my student account bill or any monies due and owing to University of Dayton by the scheduled due date, and fail to make acceptable payment arrangements to bring my account current, University of Dayton may refer my account to a collection agency. I further understand if University of Dayton refers my student account balance to a third party for collection, whether an attorney or collection agency, I may be responsible for any costs (including but not limited to collection and/or attorneys’ fees, even if there is no litigation) associated with attempting to collect the monies due and owing. I understand that if a collection fee is incurred by the University, the University may apply that fee to my account and I will be responsible to pay it. The collection fee applied to my account will be calculated at the maximum amount permitted by applicable law. For purposes of this provision, the third party may be a debt collection company or an attorney. If a lawsuit is filed to recover an outstanding balance, I may also be responsible for any costs associated with the lawsuit such as court costs or other applicable costs. Finally, I understand that my delinquent account may be reported to one or more of the national credit bureaus.

Returned Check Fees: $35 or 1% of the check amount, whichever is greater, will be assessed on checks returned by the bank (in addition to any fees I might owe my own bank).

Financial Aid

I understand aid described as “estimated” on my Financial Aid Award does not represent actual or guaranteed payment but is an estimate of the aid I may receive if I meet all requirements stipulated by that specific aid program.

I understand my Financial Aid Award is contingent upon my continued enrollment and attendance in each class upon which my financial aid eligibility was calculated. If I drop any class before completion, I understand my financial aid eligibility may decrease and some or all of the financial aid awarded to me may be revoked.

If some or all of my financial aid is revoked because I dropped or failed to attend class, I agree to repay all revoked aid disbursed to my account and resulting in a credit balance refunded to me.

I agree to allow financial aid I receive to pay any and all charges assessed to my account at University of Dayton such as tuition, fees, campus housing and meal plans, student health insurance, parking permits, service fees, fines, bookstore charges, or any other amount in accordance with the terms of the aid.

Federal Aid: I understand any federal Title IV financial aid I receive, except for Federal Work- Study (FWS) wages, will first be applied to any outstanding balance on my account for tuition, fees, and room and board. Title IV financial aid includes aid from the Pell Grant, Supplemental Educational Opportunity Grant (SEOG), Direct Loan, PLUS Loan, and TEACH Grant programs. I authorize University of Dayton to apply my Title IV financial aid to other charges assessed to my student account such as student health insurance, parking permits, bookstore charges, service fees and fines, and any other education-related charges, and I also authorize the institution to use such funds to pay other education-related charges from the prior year. I further understand this authorization will remain in effect until I rescind it or the end of Title IV Federal Student Aid Authorization, and I may withdraw it at any time. Prizes, Awards, Scholarships, Grants: I understand all prizes, awards, scholarships, and grants awarded to me by University of Dayton will be credited to my student account and applied toward any outstanding balance. I further understand my receipt of a prize, award, scholarship, or grant is considered a financial resource according to federal Title IV financial aid regulations and may, therefore, reduce my eligibility for other federal and/or state financial aid (i.e., loans, grants, Federal Work Study), which if already disbursed to my student account, must be reversed and returned to the aid source.

Method of Billing

I understand University of Dayton uses electronic billing (e-bill) through my online student account as its official billing method; therefore, I am responsible for viewing and paying my student account e-bill by the scheduled due date. I further understand failure to review my e-bill does not constitute a valid reason for paying my bill after the due date. Billing Errors

I understand administrative, clerical, or technical billing errors do not absolve me of my financial responsibility to pay the correct amount of tuition, fees, and other associated financial obligations assessed as a result of my registration at University of Dayton.

Returned Payments/Failed Payment Agreement

If a payment made to my student account is returned by the bank for any reason, I agree to repay the original amount of the payment plus a returned payment fee of $35 or 1% of the amount of payment, whichever is greater. I understand multiple returned payments and/or failure to comply with the terms of any payment plan or agreement I sign with University of Dayton may result in cancellation of my classes and/or suspension of my eligibility to register for future classes at University of Dayton.

Withdrawal

If I decide to completely withdraw from University of Dayton, I will follow the instructions at Withdrawing from the University/Leave of Absence < Udayton which I understand and agree are incorporated herein by reference.

Privacy Rights and Responsibilities

I understand University of Dayton is bound by the Family Educational Rights and Privacy Act (FERPA), which prohibits, with certain exceptions, University of Dayton from releasing any information (other than directory information) from my education record without my written permission. Therefore, I understand if I want University of Dayton to share information from my education record with someone else, I must provide written permission by filling out and submitting the FERPA consent form outlined at go.udayton.edu/ferpa, which permission(s) I may revoke in writing. I also understand that I have the opportunity to allow other users, with my permission, to access my student account at My Payment Center (go.udayton.edu/paymentcenter). I further understand I may revoke such permission(s) at any time by selecting “Consents and Agreements” when in my account at My Payment Center.

Internal Revenue Service (IRS) Form 1098-T

I agree to provide my Social Security number (SSN) or taxpayer identification number (TIN) to University of Dayton upon request as required by IRS regulations for Form 1098-T reporting purposes. If I fail to provide my SSN or TIN to University of Dayton, I agree to pay any and all IRS fines assessed as a result of my missing SSN/TIN.

I consent to receive my annual IRS Form 1098-T, Tuition Statement, electronically from University of Dayton. I understand if I do not consent to receive my Form 1098-T electronically, a paper copy will be provided. I understand I can withdraw this consent or request a paper copy by following the instructions at “Consents and Agreements” at go.udayton.edu/paymentcenter.

Student Age

I understand and agree if I am younger than the applicable age of majority when I execute this Agreement, the educational services provided by University of Dayton are a necessity, and I am contractually obligated pursuant to the “doctrine of necessaries.”

Communication

Method of Communication: I understand and agree University of Dayton uses email as an official method of communication with me and that, therefore, I am responsible for reading the emails I receive from University of Dayton on a timely basis.

Contact: I authorize University of Dayton and its agents and contractors to contact me at my current and any future phone number(s), email address(es), or wireless device(s) regarding my delinquent student account(s)/loan(s), any other debt I owe to University of Dayton, or to receive general information from University of Dayton. I authorize University of Dayton and its agents and contractors to use automated telephone dialing equipment, artificial or prerecorded voice or text messages, and personal calls and emails in their efforts to contact me.

Furthermore, I understand that I may withdraw my consent to call or text my cellphone using automated telephone dialing equipment by submitting a clear revocation request to the University’s Office of Student Accounts or to the applicable contractor or agent contacting me on behalf of University of Dayton.

Updating Contact Information

I acknowledge and understand that I am responsible to notify the University of Dayton of any changes to my current mailing addresses, email addresses, and phone numbers. You may update your information using the following procedure https://udayton.edu/academics/registrar/records/index.php. Upon leaving University of Dayton for any reason (e.g., temporary withdrawal, graduation, etc.), it is my responsibility to provide University of Dayton with updated contact information for purposes of continued communication regarding any amounts that remain due and owing to University of Dayton.

Term

This Agreement shall remain in full force and effect so long as I am an enrolled student at University of Dayton and/or have a balance in my student account, unless and until superseded by a new Financial Responsibility Agreement signed or electronically acknowledged by me; provided, that if a future Financial Responsibility Agreement is signed or electronically acknowledged by me, it does not erase any outstanding account but rather the outstanding account becomes subject to that new agreement.

Governing Law and Jurisdiction

This Agreement shall be governed by, and construed and interpreted in accordance with the laws of the State of Ohio, USA, without regard to Ohio’s choice-of-law principles. For purposes of collection of any amounts I owe to University of Dayton, I consent to the jurisdiction of the courts of the State of Ohio.

Entire Agreement

This Agreement supersedes all prior understandings, representations, negotiations, and correspondence between the student and University of Dayton, constitutes the entire agreement between the parties with respect to the matters described, and shall not be modified or affected by any course of dealing or course of performance. This Agreement may be modified by University of Dayton if the modification is signed (including by e-signature) or otherwise electronically acknowledged by me. Any modification is specifically limited to those policies and/or terms addressed in the modification.

Severability Clause

If any provision, term, or clause of this Agreement is declared illegal, unenforceable, or ineffective in a legal forum with competent jurisdiction to do so, this Agreement shall be deemed severable, and all other provisions, terms, and clauses of the Agreement will remain valid and binding on the Parties.

What is the Student Financial Responsibility Agreement (FRA)?

The Student Financial Responsibility Agreement (FRA) provides important information to students about the financial policies associated with their enrollment at the University of Dayton. This agreement sets forth the expectations for payment and policies related to, among other things, non-payment, collections, communications, financial aid, and student privacy (FERPA). By signing the agreement, students acknowledge they have read the FRA and agree to its terms.

Why do I have to complete the FRA?

The FRA is a mandatory agreement that outlines financial obligations and responsibilities for enrolling in courses at the University of Dayton.

Our goal is to help students understand the cost of their education and the financial policies associated with their enrollment at the University of Dayton. The FRA, in conjunction with our website, e-statement account information, letters and other documentation, helps explain the university’s expectations for payment, and allows us to clearly inform students of our policies related to billing, late payment, contact methods, etc. The FRA is consistent with the national movement to increase financial literacy among college students.

What if someone else is responsible for paying my account (i.e., University aid or a sponsor/employer)?

All students are ultimately responsible for their student account, including any unpaid balances, should a third-party payer fail to make payments. In addition, students may accrue other non-tuition charges on their student account which may not be covered by University aid or sponsor. Therefore, completing the FRA is an acknowledgement of a student’s responsibility for their student account.

If someone in my family pays my tuition, can they complete the Student Financial Responsibility Agreement for me?

No. While payment by a third-party is acceptable, it is the enrolled student who is ultimately responsible for agreeing to the terms and conditions of the FRA.

What if I don’t accept the FRA?

All students must indicate their acceptance of the agreement in order to be registered for courses at the University of Dayton.

How often do I have to complete the FRA?

The FRA must be completed once per academic year, or if changes to the current agreement are mandated. Students who wish to register will be presented with the FRA immediately upon entering the registration process. The FRA will typically be completed as part of the fall term registration process.
