General
The University of Dayton (the "University") Web presence is an online medium through which the University provides information and services (the "Information and Services") to individuals, such as you (the "Patron"), who access the University Web presence. The term "Web presence" extends to include all digital, mobile, social and other technologies the University may use to interact or communicate or share Information and Services with the Patron.
Websites
These terms & conditions (the "Terms") include all provisions herein, any supplemental terms (the "Supplemental Terms") as outlined at the end of the Terms, and by reference, the University's Privacy Policy. The Terms govern use by the Patron of the websites located within udayton.edu.
In using, or otherwise accessing any of the University's websites and/or the Information and Services contained within, the Patron agrees to comply with the Terms.
Patron Use
The University's websites and the Information and Services contained within are comprised of elements that are copyrighted, trademarked, or otherwise proprietary. All content, including text, graphics, logos, photos, audio, and video: as well as all structure, including navigation, layout, computer code, visual design, user interfaces, and information architecture (collectively, the "Content and Structure"): is the property of the University and/or respective Content and Structure originators. All subsequent Information and Services, as well as all subsequent University websites, individually and collectively, are the property of the University and/or respective originators. The Patron may make personal, non-commercial use of the University's websites. Such personal use is limited to routine activity designed to allow the Patron to read, print, view, listen to, and/or download with the intent to read, print, view, and/or listen to, Information and Services contained within the websites. With the exception of such personal use, the Patron may not otherwise download, modify, copy, reproduce, republish, upload, post, transmit, distribute, sell, or create derivative works from any of the Information and Services and/or Content and Structure of the websites, or any portion of the same, in whole or in part, without the express consent of the University. Frames or framing techniques may not be utilized to enclose any portion of the websites without the express consent of the University. The right to create active hyperlinks to any portion of the websites is granted, so long as the active hyperlinks and associated context do not portray the University and/or related originators in a false, offensive, derogatory, or otherwise misleading manner.
Patron Association with the University
Patron association with the University such as with Patrons who are members of the University administration, faculty, staff, student body, alumni, or similar audiences: does not grant any use of the websites beyond those articulated in the Terms.
RSS and Podcast Technologies
Some University websites offer Information and Services via RSS and Podcast technologies. The right to subscribe to RSS- and/or Podcast-enabled Information and Services is granted to the Patron for personal, non-commercial use. Such personal use is limited to routine activity designed to allow the Patron to read, print, view, listen to, and/or download with the intent to read, print, view, and/or listen to, RSS- and/or Podcast-enabled Information and Services contained within the websites. With the exception of such personal use, the Patron may not otherwise download, modify, copy, reproduce, republish, upload, post, transmit, distribute, sell, or create derivative works from any of the RSS- and/or Podcast-enabled Information and Services and/or Content and Structure of the websites, or any portion of the same, in whole or in part, without the express consent of the University.
Disclaimers and Limitation of Liability
The University does not warrant that the University's websites will be available uninterrupted, nor that the websites will be error free. The University makes no warranty as to the result of use of the University's websites, nor to the accuracy, reliability, or substance of any information and services offered through the websites. The University's websites are provided "as is" without warranty. The University disclaims to the fullest extent permitted by law all warranty, either expressed or implied, including without limitation, the implied warranties of merchantability, fitness for use of a particular purpose, or noninfringement of proprietary rights. The University disclaims any warranties with regard to the security, reliability, timeliness, and performance of the University's websites. The University, its trustees, officers, employees and other representatives shall have no liability for any damages, including without limitation, direct, indirect, consequential, compensatory, special, punitive, or incidental damages arising out of or relating to the use of the University's websites.

Modification

Supplemental Terms
The following Supplemental Terms are provided for SMS Messaging Programs:
By participating in any SMS Messaging program you will receive the number text messages indicated in your opt-in message regarding the University of Dayton affiliated text program. Most programs send no more than three messages per month. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
You must be the mobile phone account holder or have permission from the account holder to use this service. You must be 18 years or older or have permission from a parent/guardian. By participating in this program you specifically authorize University of Dayton to send telemarketing communications using an automatic telephone dialing system or an artificial or prerecorded voice system. You are not required to sign the agreement as a condition of purchasing any property, goods or services. The person consenting to receive telemarketing communications also provides authorization for the specific telephone number that may be contacted via this program.

Recruitment and Admission
The University of Dayton’s Office of Recruitment and Admission sends text messages using an SMS/MMS messaging service to communicate with students about application and enrollment deadlines, application updates, event notifications and reminders, and other important information about the admissions process. Messages may also be sent to parents/guardians of prospective students. Subscribing to this service is not required to apply for or gain admission to the University. This service provides you with information via text messaging the University deems helpful and pertinent to the admission process.
Messages are sent from 800-UD-PRIDE (800-837-7433), 937-229-4411, 937-229-4719, 937-229-1397, 937-229-1518, 937-229-1525, 937-229-4589, 937-229-4957, 937-229-4932, 937-229-2874, 937-229-4474, 937-229-4979, 937-229-5595, 937-229-5598, 937-229-5596 and 937-229-4411.
Recipients may opt in in the following ways:
- When registering for an admission visit or event.
- On the University of Dayton application for admission or the Common App.
- On the My Profile page in the Admission Account.
No mobile information, including SMS opt-in data, will be shared with third parties or affiliates for their direct marketing or promotional purposes. To opt-out, recipients can text STOP to the number that sent the message, or update their profile in the Admission Account. Advancement
Advancement utilizes text messaging to send out important notifications and updates about opportunities from the University of Dayton to alumni, volunteers, event guests, students and their parents/guardians. Messages are sent from 937-358-8918, 937-745-1479, 937-745-1474, 937-249-8051, 937-365-0428, 937-365-2001, 937-530-6110, 937-560-8084, 937-980-1194, 937-530-6108, 937-560-8238, 937-980-1260 and 937-365-0394. Recipients may opt in in the following ways:
- Submitting the contact information form
- Submitting the family profile form
- Submitting contact information in the alumni directory
- When registering for an event
- When making a donation
- When signing up to volunteer

Public Safety
University of Dayton Public Safety utilizes the Send Word Now service to send emergency notifications to UD faculty, staff and students. Faculty, staff and students can opt in to receive text messages on Porches.
