Certificates of Insurance

The University requires third parties to provide certificates of insurance evidencing insurance coverage. 

Minimum Insurance Requirements

General Liability Limits

  • $2,000,000 General Aggregate per Project
  • $2,000,000 Products/Completed Operations Aggregate
  • $1,000,000 Each Occurrence 
  • $1,000,000 Personal & Advertising Injury 
  • $   100,000 Fire Damage Liability
  • $       5,000 Medical Payments per Person 

Automobile Insurance Limits

  • $1,000,000 Each Accident

For owned, leased, hired, and non-owned automobiles


Worker’s Compensation / Employers’ Liability (Ohio Stop Gap) Limits

Statutory State Limits and Coverages

  • $1,000,000 Each Occurrence for Employers’ Liability

Umbrella or Excess Liability 

  • $2,000,000 Each Occurrence
  • $2,000,000 Annual Aggregate 

Professional Liability (if applicable)

If Vendor is a licensed architect, engineer, designer or other “professional”, they shall supply a certificate of insurance, including two (2) years following, professional liability insurance for claims arising from real or alleged errors, omissions, or negligent acts committed in the performance of professional or technical services associated with Agreement.

Pollution Liability (if applicable)

Cyber/Technology Liability (if applicable)

Sexual Misconduct Liability (if applicable)

  • $1,000,000 for all Claims for Wrongful Acts against any one victim
  • $2,000,000 for all Claims for Wrongful Acts against all victims

Note

University reserves the right to require other insurance requirements depending on the nature of the service or goods (e.g., Charters, etc.,).  All subcontractors must maintain same requirements.

Insurance Companies

All Required insurance policies shall be written through insurance companies licensed to do business in the State of Ohio and have a minimum rating of “A” (AM Best or equivalent). Insurers with lower than an “A” rating or unlicensed in the state of Ohio shall be subject to the approval of UD’s Risk Manager.

Certificate of Insurance

The University of Dayton is to be listed as the Certificate Holder verifying the minimum insurance coverage and the additional insured statement:

"The Additional Insured shall include The University of Dayton, its affiliates and subsidiaries, members, directors, officers, employees, and volunteers. Coverage provided shall be primary to the Additional Insured’s and not contributing with any other insurance or similar protection available to the Additional Insured’s whether other available coverage be primary, contributing or excess."

Property

Contractor or Third-Party's Property – Responsibility for loss and insurance coverage for this property is the sole responsibility of the Contractor (and Subcontractors).

Project Property – Contractor shall obtain and maintain, throughout the duration of this Contract, Renovation or New Construction Builders' Risk in an amount of Contractor's completed amount of work (material, labor and all related expenses) provided by this Contract. UD shall be named as a Loss Payee, ATIMA.

Project materials– Contractor shall obtain and maintain, throughout the duration of this Contract, an Installation Floater covering 100% of the Replacement Cost covering project materials in transit and on the job site. UD shall be named as a Loss Payee, ATIMA.

Special Events Coverage for Third-Party Events held at UD

Overview

Any third party wanting to use the University of Dayton facilities must carry liability insurance.  The University of Dayton recommends using the TULIP to third parties who have no liability insurance.  The TULIP is a Tenants' and Users' Liability Insurance Policy that provides special event liability coverage. It protects both the third party and the University against claims by third parties who may be injured or experience damage to property as a result of participating in an event. For all events, the University of Dayton should be named as Additional Insured.
