Faculty Rights & Responsibilities

OLR recognizes that as faculty, you may have concerns about your rights and responsibilities when working with students with disabilities. 

  • The Americans with Disabilities Act (1990) stipulates that postsecondary institutions must provide necessary accommodations when a student discloses a disability. Under federal disability law, you and your program are responsible for providing accommodations for which the students have been approved through OLR's accommodations process. 
  • Accommodations are a variety of techniques and services that provide a student with disabilities full access to the general curriculum. They do not compromise the essential elements of a course or curriculum; nor do they weaken the academic standards or integrity of a course. Accommodations provide an alternative way to accomplish the course requirements by eliminating or reducing disability-related barriers. They provide a level playing field, not an unfair advantage.

Include the Disability Statement

Refer Students to the Office of Learning Resources

  • If a student requests accommodations directly from you or identifies as a person with a disability but they have not registered with OLR, encourage them to initiate the Accommodations Request Process with the OLR.
  • If a student reports difficulties with study skills or course content, let them know OLR can also be of assistance through free academic coaching, tutoring, and supplemental instruction.

Communicate with OLR Disability Staff

  • If you have questions about how to provide accommodations or question if an accommodation might fundamentally alter the objectives or essential requirements of the course, please contact OLR Disability Staff.
  • If a student requests an accommodation outside of the established timeframe and you are agreeable to allowing the accommodation, let OLR Disability Services Staff know via e-mail.

Respect Confidentiality

  • A student’s disability and/or the fact that they use accommodations should not be announced or referred to in class.
  • Conversations with the student should be held in a respectful and discrete manner.

Communicate with Your Student(s) 

  • Eligible students must deliver their accommodation to you, printed or via email, before receiving accommodations. We strongly recommend to students that they communicate with you regarding the approved accommodations they wish to use in your class.  By having a conversation with the student, you can determine how best to put the approved accommodations into practice.
  • Students may not be comfortable discussing their accommodations in front of others. Offer to speak with them privately or during office hours.

Provide Approved Accommodations

  • You are obligated to provide only the accommodation(s) identified in the Accommodation Letter.
  • If you have questions about how to provide accommodations or question if an accommodation might fundamentally alter the objectives or essential requirements of the course, please contact OLR Disability Staff.
  • Ffaculty are encouraged to consider accessibility, including accessibility of transportation, for out-of-class locations and events. 
  • If you provide services in another physical location, via distance learning, or students are participating in a clinical component of an educational program (e.g. internship, practicum, or student teaching), it may be necessary for OLR Disability Services staff, the clinical experience professor, the on-site supervisor and the student to meet before the experience begins. Request for accommodation(s) must be approved by OLR and other university officials as necessary. Click here for more information about Off-Campus Accommodations.
  • Neither you nor OLR is obligated to provide academic accommodations if the student fails to make their request(s) in a timely fashion following OLR's guidelines.  If a student does not follow the appropriate guidelines and timelines, it is their responsibility to speak with you to see if you will accommodate their request(s).

Provide Necessary Test Information to the Testing Center

Understand the Accommodation Process for Students

  • Students seeking accommodations while at the University of Dayton must complete the Accommodation Process with the Office of Learning Resources.
  • If approved for accommodations, OLR will notify eligible students regarding accommodation recommendations for each class in which the student is enrolled. Students are responsible for notifying their professors of their accommodations. 
  • Students can present you with an accommodation letter from OLR at any time during the semester, either in person or through email. It is your responsibility to implement the accommodations in the letter from that time forward; accommodations are not retroactive. We encourage you to speak with the student after receipt of the letter to discuss which accommodations will be used and how best to implement them for your course.    
  • Due to the diversity of individual needs relating to disabilities and the uniqueness each class presents, accommodations may vary from class to class.
  • The student has the right to use any, all, or none of their accommodations at any time during the semester.  This decision can change throughout the semester. However, accommodations are not retroactive.

  • If a you have a concern related to a student's approved accommodations, contact OLR Disability Services staff.

Set Expectations

  • Expect that enrolled students are academically qualified and students with disabilities should be held to the same academic and behavior standards as all other students.

Accommodating Requests

  • Neither you nor OLR is obligated to provide academic accommodations if the student fails to make their request(s) in a timely fashion following OLR's guidelines. If a student does not follow the appropriate guidelines and timelines, it is their responsibility to speak with you and it is up to you whether you will accommodate their request(s).
