December 2010 Faculty Briefs

Associate Professor Tracy Reilly's article "Debunking the Top Three Myths of Digital Sampling: An Endorsement of the Bridgeport Music Court's Attempt to Afford 'Sound' Copyright Protection to Sound Recordings," was recently cited in an appellate brief filed in U.S. Court of Appeals for the Eleventh Circuit. The article, published in 2008 in the Columbia Journal of Law & the Arts, was cited for the proposition that digital sampling is a physical taking and, therefore, a violation of copyright laws.
